McLaren will not be punished over their possession of confidential Ferrari data after Formula One racing’s governing body, the FIA, decided there was no proof that the team had made use of the information.

However, the FIA did find McLaren to be in breach of the International Sporting Code and warned them that they could face exclusion from the championship if they are subsequently found to have used the material.

The FIA said it also looking into possible legal action against Mike Coughlan - McLaren's suspended chief designer, who was in possession of the Ferrari documents - and Nigel Stepney, the sacked Ferrari engineer who is alleged to have supplied them.

Following Thursday’s extraordinary meeting of the FIA’s World Motor Sport Council, the following statement was issued:

“The WMSC is satisfied that Vodafone McLaren Mercedes was in possession of confidential Ferrari information and is therefore in breach of article 151c of the International Sporting Code. However, there is insufficient evidence that this information was used in such a way as to interfere improperly with the FIA Formula One World Championship. We therefore impose no penalty.

“But if it is found in the future that the Ferrari information has been used to the detriment of the championship, we reserve the right to invite Vodafone McLaren Mercedes back in front of the WMSC where it will face the possibility of exclusion from not only the 2007 championship but also the 2008 championship.

“The WMSC will also invite Mr Stepney and Mr Coughlan to show reason why they should not be banned from international motor sport for a lengthy period and the WMSC has delegated authority to deal with this matter to the legal department of the FIA.”

Ferrari react to WMSC findings

The following is a statement from Ferrari in which the team comment on the findings of the World Motor Sport Council with regard to McLaren Mercedes.

Based on today’s decision of the FIA World Council:

# The Vodafone McLaren Mercedes team has been found to be in breach of article 151c of the F1 Sporting Regulations and to have therefore behaved in “a fraudulent manner and therefore in a manner prejudicial to the interests of competition or motor sport in general,”

# The World Council has nevertheless decided that, in the absence of any definite proof that information that is the property of Ferrari has been effectively used on the Vodafone McLaren Mercedes car competing in the current championship, it can impose no sanction without further evidence.

Ferrari notes that Vodafone McLaren Mercedes has been found guilty by the FIA World Council.

It therefore finds it incomprehensible that violating the fundamental principle of sporting honesty does not have, as a logical and inevitable consequence, the application of a sanction. Today’s decision legitimises dishonest behaviour in Formula 1 and sets a very serious precedent.

In fact, the decision of the World Council signifies that possession, knowledge at the very highest level and use of highly confidential information acquired in an illicit manner and the acquiring of confidential information over the course of several months, represent violations that do not carry any punishment. The fact that Vodafone McLaren Mercedes was in possession of such information was discovered totally by accident and, but for this, the team would continue to have it. This is all the more serious as it has occurred in a sport like Formula 1 in which small details make all the difference.

Ferrari feels this is highly prejudicial to the credibility of the sport. It will continue with the legal action already under way within the Italian criminal justice system and in the civil court in England.

masa, koliko sam ja gledao, je izashao sa namerom da izveze najbrzi krug i sakovao je. jeste on proshao za vreme q2 kroz cilj, tj u poslednjih 10 sekundi, shto znachi da je mogao da odveze josh jedan krug ali kontam da za to nije imao djusa.

btw jel dozvoljeno dolivanje goriva pre svake qualifying runde ili se to moze samo na pochetku kvalifikacija?

da, tako nešto, znam da uglavnom nije mogao da izveze brzi krug zbog manjka goriva.

gorivo mogu da sipaju pre svake runde kvalifikacija, al ne mogu između kvalifikacija i trke.

Dok u McLarenu vlada pravi haos... Briatore baca nove izjave:

Flavio Briatore has suggested that McLaren was only able to keep up with Ferrari this year because of the spy scandal.

The Renault boss, who respectively beat McLaren and Ferrari for the world championships in 2005 and 2006, said he does not believe his counterpart Ron Dennis that no-one except Mike Coughlan at McLaren knew about the 780-page dossier of Ferrari secrets.

Briatore said the biggest disadvantage compared to Ferrari this year was its rivals' lack of knowledge of the Bridgestone tyres.

"Had I only known Ferrari's weight distribution, or how big their tank is, if I had a bit of those documents, then we surely wouldn't be in this situation today," the Italian told La Gazzetta dello Sport.

McLaren is currently subject to the suspicions of the FIA about the espionage saga, but Dennis insists that his suspended chief designer Coughlan acted entirely alone.

Briatore charged: "Dennis says he's immaculate, but it's hard to believe him. No, I don't believe in his good faith. In a team everyone knows everything."

He also criticised Dennis for not yet sacking Coughlan, while Ferrari has on the other hand dismissed alleged McLaren informer Nigel Stepney.

"It's an extremely serious thing that he hasn't yet been fired," Briatore said, referring to Coughlan.

"All the team managers should say that in F1 there's no more room for them."

koliko znam i proshle dine su mnogi prolazili kroz srbiju na putu do turske.

McLaren was only able to keep up with Ferrari this year because of the spy scandal

brate, meklaren je imao ferarijevu tehničku dokumentaciju, to niko ne osporava. treba da verujemo da je nisu (zlo)upotrebili samo zato što su pošteni ljudi? L.O.L.

a što se tiče alonso vs. hamilton netrpeljivosti, 70% sam siguran da je to samo PR.

'de nisu. raste gledanost, režiser više prikazuje meklarene -- logo sponzora je duže na ekranu većeg broja gledalaca. u celoj priči sa finansijskog aspekta nema pravih gubitnika; alonso i hamilton su obojica dovoljno dobri da im ovo ne upropasti karijere, a običan gledalac je nasamaren, kao i uvek.

Alonso free agent in 2008?!

Fernando Alonso, who is at daggers drawn with his McLaren co-driver Lewis Hamilton, has been told by boss Ron Dennis that he can leave McLaren at the end of the season, a report claimed on Tuesday.

The double world champion's future is up in the air as his relationship with Hamilton broke down at the Hungarian Grand Prix last weekend when he was penalised for his part in trying to prevent the Briton from starting in pole.

The Times quoted what the paper described as a 'well-placed' source as confirming Alonso may quit the team two years ahead of schedule.

"My understanding is that he's been told he can go because they're so fed up with him. Ron is just very pissed off with both of them," the unnamed source said.

These comments follow Alonso's confirmation that his future at the British team was uncertain. The unsettled Spaniard, asked by sports daily Marca if he was planning to stay with McLaren, replied: "I don't know."

Two likely destinations for Alonso if he were to sever his ties with McLaren are Renault, with whom he won his two world titles, and BMW, who are yet to confirm Nick Heidfeld for 2008.

International Court of Appeal date set

McLaren under investigation again for rules breach

As we reported this morning, the International Court of Appeal (ICA) will meet in the second week of September to determine the fate of the McLaren Mercedes team. The following is a statement from the FIA.

"The International Court of Appeal will meet in Paris on Thursday September 13, 2007 to hear a referral by the President of the FIA concerning a decision of the World Motor Sport Council regarding a breach by the Vodafone McLaren Mercedes team of Article 151© of the International Sporting Code.

"The referral was made by the FIA President under the terms of Article 23(1) of the FIA Statutes and Article 1 of the ICA Rules and Procedure.

"In the interests of transparency the hearing will be open to members of the press and details of the accreditation procedure will be published closer to the time.

"All of the teams competing in the 2007 FIA Formula One World Championship have been given the opportunity to make written submissions to the ICA and have been invited to attend the hearing to supplement their submissions with oral presentations."

sve je to lepo, samo tu ima jedan problem. zar zaista mislish da bi alonso mirno sedeo sa strane i gledao kako mu polako odlazi titula.

ne mislim, ali ne mislim ni da bi lik koji je prethodne dve titule osvojio tako što je psihički stabilniji od konkurencije odjednom počeo da se ponaša kao retard.

a kapiram da bi Crash bio u fazonu HAMILTON JE BOG, samo da vozi za Ferrari :)

btw, da ne bude da ja tu sad nesto branim hamiltona, gotivim ja i njega i kimija, ali prepisati mu pobede na rasnoj osnovi je glupavo
